摘　　要：生态司法是司法机制“绿色化”的彰显,也是生态命运共同体理念的体现。“生态司法+林业碳汇”是我国司法实践中探索出的新型生态环境修复方式,既具理论性也具实践性。本文在考究“生态司法+林业碳汇”的概念内涵的基础上,对最高法发布的典型案例予以分析并概括出新发展表征,剖析并厘清“生态司法+林业碳汇”作为生态环境损害修复方式的适用困境,提出须完善林业碳汇相关法律规范、健全林业碳汇物权担保制度和替代履行制度,以此实现生态司法的“绿色”使命。Ecological justice is not only the manifestation of the"greenness"of judicial mechanism,but also the embodiment of the concept of ecological community with a shared future."Ecological justice+Forestry carbon sequestration"is a new way of ecological environment restoration explored in the judicial practice of our country,which is both theoretical and practical.On the basis of studying the concept and connotation of"Ecological justice+Forestry carbon sequestration",this paper analyzes the typical cases issued by the Supreme People's Court and summarizes the characterization of the new development.This paper analyzes and clarifies the dilemma of the application of"Ecological justice+Forestry carbon sequestration"as a way to repair eco-environmental damag and puts forward that it is necessary to improve the relevant laws and regulations of forestry carbon sequestration,the guarantee system of real right of forestry carbon sequestration and the alternative performance system in order to realize the“green”mission of ecological justice.
