摘 要:“处罚与教育相结合”乃行政处罚的基本原则。由该原则衍生出的教育优先、寓教于罚、以教代罚等子原则构成了行政处罚制度不可分割的重要组成部分。相较于行政处罚措施而言,行政教育措施具有程序上的前置性、优位性、过程性和功能上的目的性、人文性、替代性。基于此,“不教而罚”有违程序正当,“罚而不教”有违目的正当,“不罚不教”有违履职正当。为规范行政教育措施,充分发挥其本体性、程序性、目的性价值,有必要在行政处罚制度中进一步明确其理论定位和制度定位,完善其规范建构。"Combination of punishment and education"is the basic principle of administrative punishment.The sub-principles derived from this principle,such as education first,edutainment in punishment,and education instead of punishment,constitute an integral part of the administrative punishment system.Compared with the administrative punishment measures,educational measures are preemptive,superior and procedural atthe procedural levelandpurposeful,humanistic and substitutable.at the functional level.Accordingly,"punishment without education"is against the due process,"punishment without education"is against the due purpose,and"punishment without education"is against the due performance of duties.In order to standardize administrative education measures and give full play to their ontological,procedural and purposeful values,it is necessary to further clarify their theoretical and institutional positioning in the administrative punishment system and improve their normative construction.
