数字政府技术资本侵蚀的生成机理与法律规制

摘　　要：在建设数字政府的过程中,政府对技术资本存在不同程度上的技术依赖、信息依赖以及决策依赖。技术上的优势使得技术资本开始不断侵蚀政府固有的权力架构和组织形态,并在无形中消解了行政主体的独立人格,解构了行政权力的公共属性,分化了政府的公信与权威,侵害了公民的数据权利,为我国数字市场的繁荣发展埋下了隐患。技术资本入驻的审查标准缺失、基本权利保障理论的适用障碍、技术资本的监管体系不健全、社会性力量的边缘化是当前技术资本侵蚀的主要制度根源。基于此,今后必须明晰技术资本合作的审查标准,强化公民数据权的国家保护义务,加强数字平台的合规化建设,推进公众对数字政府的深度参与,完善党对数字政府建设的法治化领导,从而将数字政府的建设和运行纳入法治化轨道之中。In the process of building digital government,the government depends on technology,information and decisionmaking to varying degrees on technology capital.With technical advantages,technical capital makes a hidden danger for the prosperity and development of China's digital market,which erode the inherent power structure and organizational form of the government,and virtually dispel the independent personality of the administrative sub-ject,deconstruct the public attribute of administrative power,divide the government's public trust and authority,and infringe citizens'data rights.At present,the main institutional roots of the erosion of technological capital are the lack of technical capital of entry review standards,the applicable theory of basic rights protection,the imperfect supervision system of technological capital and the marginalized social forces.Based on this,in the future,we must clarify the re-view standards of technical capital cooperation,strengthen the national protection obligations of citizens'data rights,strengthen the compliance construction of digital platforms,promote the deep participation of the public in digital gov-ernment,and improve the Party's legal leadership over the construction of digital government so as to bring the con-struction and operation of digital government into the track of rule of law.
