摘　　要：轻罪治理的惩治效果与复归效果同等重要。广义轻罪概念包含立法轻罪(典型与非典型)与司法轻罪。轻罪的刑事一体化治理包括三个维度:一是刑法内部的解释论限制机制;二是整体刑事法视野下,实体“严”到程序“宽”的过滤机制;三是统一法秩序内刑罚附随后果的轻缓化。立法轻罪的治理应坚持刑法解释的保守性立场,考虑规制手段是否符合比例原则,区分规范保护目的,合理运用行刑衔接。基于恢复性司法观念,轻罪治理以发挥司法程序的教育规训功能为关键。在程序上相对不起诉的机制完善以赋予检察官更大的需罚性判断权为路径,并以综合施策构建多元非刑罚治理方式为条件。轻罪治理最终指向的是塑造、恢复行为人的规范认同意识,促使行为人顺利复归社会。The effect of punishment and the effect of rehabilitation are equally important.The broad concept of misdemeanors includes legislative misdemeanors(typical and atypical)and judicial misdemeanors.The integrated governance of misdemeanors includes three dimensions:First,the constraining mechanism of interpretation theory in criminal law;second,the filtering mechanism from substantive“strictness”to procedural“leniency”in the perspective of the overall criminal law;third,the lightening of the consequences of penalty in the unified legal order.The governance of legislative misdemeanors should adhere to the conservative stance of criminal law interpretation,consider whether the regulatory means conform to the principle of proportionality,distinguish the purpose of normative protection,and rationally use the convergence of execution.Based on the concept of restorative justice,the misdemeanor governance focuses on playing the educational and disciplinary function of the judicial process,and the improvement of the mechanism of relative non-prosecution in the procedure is to give prosecutors more power to judge the need for punishment,and to construct multiple non-penalty treatment methods by comprehensive policies.The ultimate point of misdemeanor management is to shape and restore the perpetrator’s normative identity,and to promote the perpetrator’s successful reintegration into society.
