摘　　要：软法治理对于强化档案治理体系、提升档案治理能力具有重要的价值,是助力中国式档案治理现代化的重要方式。在实践场域上,软法治理以档案“软性条款”和“社会软法”为规制载体,以档案政策、自律规范、档案标准为作用对象,完善档案规范的供给格局。在运行逻辑上,软法治理凭借“前软法”“后软法”“并行软法”和“独立软法”的外在形态,依托“软硬协同”“附属转接”“行政传导”和“资源辅助”的内在机制,推动档案资源的多元整合。价值在场、技术适配和制度保障是实现档案软法治理的优善面向。Soft law governance has an important value in strengthening the archival governance system and enhancing archival governance capabilities,and is an important approach to modernizing Chinese style archival governance.In the practical field,soft law governance takes the“soft clauses”and“social soft laws”of archives as regulatory carriers,and takes archival policies,self-discipline norms,and archival standards as the objects of action to improve the supply pattern of archival norms.In terms of operational logic,soft law governance relies on the external forms of“pre soft law”,“post soft law”,“parallel soft law”,and“independent soft law”,and relies on the internal mechanisms of“soft and hard coordination”,“subsidiary transfer”,“administrative transmission”,and“resources assistance”to promote the diversified integration of archival resources.The presence of value,technological adaptation,and institutional guarantee are the optimal aspects for achieving soft law governance of archives.
