摘 要:直播打赏关系的性质界定对消费者权益保护与纠纷预防具有重大意义。直播打赏关系中虚拟货币的转移作为实质上的财产转移值得法律评价和规范,该关系完全符合合同成立的要件,应被认定为独立的合同关系。直播打赏基本运行模式为“非强制性付费”商业模式,基于对主播与观众之间真实意思表示的尊重,直播打赏合同不宜被认定为赠与合同,而应是网络服务合同。相较于平台和观众之间的网络服务合同,直播打赏网络服务合同在格式、主体、权利义务、履行等方面具有特殊性,可以考虑引入打赏冷静期作为配套措施,但在其具体规则的设计上应注重规制消费者的“恶意反悔”。同时,直播平台作为网络服务交易平台提供者,在不能提供主播的有效联系方式时,应当依据《消费者权益保护法》规定,承担对消费者的先行赔偿责任,以辅助相关纠纷的妥善化解。The definition of the nature of the live broadcast reward relationship is of great significance to the consumer rights protection and disputes prevention.The transfer of virtual currency in the live broadcast reward relationship,as a substantive property transfer,deserves legal evaluation and regulation.This relationship fully meets the requirements of the establishment of the contract and should be recognized as an independent contractual relationship.The basic operation mode of live broadcast reward is the “non-mandatory payment” business model.Based on the respect for the real intention expressed between the anchor and the audience,the live broadcast reward contract should not be identified as a gift contract,but a network service contract.Compared with the network service contract between the platform and the audience,the live broadcast reward network service contract has its particularity in terms of format,subject,rights and obligations,performance,etc.It can be considered to introduce the reward cooling-off period as a supporting measure,but the design of its specific rules should focus on regulating consumers’ “malicious reneging”.At the same time,as a provider of network service trading platform,if the platform fails to provide the effective contact information of the anchor,it shall bear the liability of compensation to the consumer in advance in accordance with the provisions of the Law on Protection of Consumer Rights and Interests,so as to assist the proper resolution of relevant disputes.
