摘　　要：法的社会科学研究自20世纪80年代起在国内兴起,后又经历了自发研究和自觉研究的阶段,从最早的法社会学拓展到法社会科学。法的社会科学研究包括外部视角和内部视角两个方面。外部视角关注法与社会的关系,内部视角则是对立法、执法、司法和守法过程进行社会科学研究。当前,法的社会科学研究在国内已经形成了相当规模,并且出现了分化与交锋,如何处理法律经验研究与法律理论研究、法律定性研究与法律定量研究、部门法学(法教义学)研究与法的社会科学研究这三组关系成为新的焦点。就整体来看,法的社会科学研究需要进一步加强与部门法学研究、社会科学研究的联系,特别是要注意在法律实务中总结社会科学的运用经验,密切关注国外法的社会科学研究的前沿动态,力求在中国经验和理论反思的基础上建构中国自主的法的社会科学知识体系。The social science research of law began to emerge in China since the 1980s.It has gone through spon-taneous and conscious stages,expanding from earliest sociology of law to its present form of social science.The social science research of law encompasses two aspects:external perspective and internal perspective.The external perspec-tive focuses on the relationship between law and society,while the internal perspective concerns itself with the process of legislation,law enforcement,justice and law compliance.At present,it has reached a considerable scale in China with divisions and conflicts arising therein.The way to deal with three pairs of relationships has become a new focus:between empirical legal research and theoretical legal research,qualitative legal research and quantitative legal research,and the research of positive law(legal doctrine)and the social science research of law.On the whole,the social science research of law needs to further strengthen its connection with positive law research and social science research.A close attention should be paid especially to the experience of summarizing the application of social sci-ence in legal practice and to the frontier development of foreign social science research of law,so as to build China's independent social science knowledge system of law on the basis of Chinese experience and theoretical reflections.
