法治现代化的“中国式”内涵及其具体面相

摘　　要：中国式法治现代化既具有世界法治文明的共性又具有中国自身的特性。中国的法治现代化自身的特性是被“中国式”这一概念所决定和表征的。中华传统文化以其特有的魅力形塑着当下中国人的思维逻辑和行为方式,进而决定着中国法治现代化的“中国式”特征。近现代曲折而丰富的社会和法治发展实践决定了中国的法治现代化必然具有“中国式”的内涵。超大型的国家和其人民特有的生活方式导致了当下中国的法治建设会呈现出一定的复杂性和特殊性,这些复杂性和特殊性共同形塑着法治现代化的“中国式”内涵。基于这些内涵,中国式法治现代化是一种自主性的法治现代化、多元性的法治现代化、反思性的法治现代化。Chinese modernization of the rule of law has both the commonness of the world civilization of rule of law and the Chinese characteristics.The characteristics of Chinese modernization of rule of law are determined and characterized by the concept of"Chinese".The Chinese traditional culture,with its unique charm,shapes the current Chinese thinking logic and behavior,and determines the"Chinese"characteristics of the modernization of the rule of law in China.The tortuous and rich social and legal development practice in modern times determines that Chinese modernization of the rule of law must have the connotation of"Chinese".The unique lifestyle of the super large country and its people has led to the complexity and particularity of Chinese current rules of law construction,which shapes the"Chinese"connotation of the rule of law modernization.Based on these connotations,Chinese modernization of the rule of law is an autonomous modernization of the rule of law,a pluralistic modernization of the rule of law,and a reflective modernization of the rule of law.
