摘　　要：在中国特色社会主义新时代,学界对新兴权利的研究已日趋成熟且取得了一些阶段性成果,主要表现为深耕法理、拥抱科技、聚焦司法和关怀社会四个方面的内容。新兴权利的基础理论研究日益深化,其基本范畴和理论根基更为成熟;科技进步拓展了新兴权利的研究主题,人工智能领域的新兴权利、信息与数据权利、基因权利的研究日渐丰富;司法逐步成为学界关注的焦点,新兴权利的研究立场经历着从立法到司法的转向;民生与社会权利始终是新兴权利研究不变的主题,社会权的性质和内容更为清晰,社会弱者权利得到了更多关注。以此为基础,今后的新兴权利研究应继续突出时代主题、深化理论研究、注意研究方法、侧重交叉学科,以期实现研究水平和质量的进一步提升。In the new era of socialism with Chinese characteristics,research on emerging rights has become increasingly mature and has achieved some milestones,mainly in four aspects:deepening jurisprudence,embracing science and technology,focusing on justice and caring for society.The research on the basic theory of emerging rights has deepened,and its basic scope and theoretical foundation have become more mature.Scientific and technological progress has expanded the research themes of emerging rights,and the research on emerging rights in the field of artifi-cial intelligence,information and data rights,and genetic rights has become more and more abundant.The judiciary has gradually become the focus of academic circles,and the research position of emerging rights has experienced a shift from legislation to judiciary.People's livelihood and social rights have always been the constant theme of the research on emerging rights.The nature and content of social rights have become clearer,and the rights of the socially disadvantaged have received more attention.Based on this,future research on emerging rights should continue to high-light the theme of the times,deepen theoretical research,pay attention to research methods,and focus on cross-disci-plines,with a view to further improving the level and quality of research.
