浅议权利人视角下的集成电路布图设计专有权的权利主张

摘　　要：从国家知识产权局统计的集成电路布图登记状况的数据可知集成电路行业的企业越来越重视集成电路布图设计的权利保护,而在面临集成电路布图设计引起的知识产权纠纷时,可借鉴的经验又很少。依据《集成电路布图设计保护条例》的规定,从集成电路布图设计的保护体系与独创性构成要件、集成电路布图设计权利人独创性主张的现状,引出布图设计权利人主张专有权的建议。布图设计权利人只有合理地主张权利,才能在集成电路布图设计引起的知识产权纠纷中有效地保护自己的合法权益。According to the registration data of layout-design collected by CNIPA(China National Intellectual Property Administration),the IC enterprises pay more and more attention to the right of layout-design of integrated circuits.However,there is little experience with the layoutdesign disputes.According to the Regulations for the Protection of Layout-design of Integrated Circuits,this paper expounds the protection system of layout-design of integrated circuits and constitutive elements of originality,and the reality of the original claims of a layout-design holder,then extends to the suggestions for claiming exclusive rights.The holders can be to successfully protect the legitimate rights in the layout-design of integrated circuits disputes only when they reasonably claim the right.
