摘　　要：电池领域的专利申请中存在较多以参数限定的产品权利要求,并且参数的表征形式、测定方法各异,这类案件的新创性评价一直是该领域专利申请撰写和审查的难点所在。文章从多个复审和实审案例出发,从参数限定本身的类型入手,着眼于权利要求中参数的不同测定方法以及参数限定的产品在说明书中给出的制备方法两个角度,针对电池领域参数限定权利要求的新颖性推定、创造性评价等方面分别进行讨论,为包含参数限定的电池领域专利申请撰写和审查提供可行的参考建议。There are many product claims limited by parameters in battery patent application and examination,and the characterization forms and measurement methods of parameters are various.The novelty and inventive step examination of such cases has always been a challenge in this field.This article discusses this problem from measurement methods of parameters in the claims and the preparation methods provided in descriptions based on several substantive examination cases and re-examination cases.And this article discusses the novelty estimation and inventive step evaluation of claims limited by parameters in battery field,and provides reference suggestions for claims with parameters in battery patent application and examination.
