论我国法定数字货币的监管与法律规制

摘　　要：当下我国数字经济方兴未艾,数字经济的兴起与发展,改变了传统经济领域中的应用场所、技术手段以及相关制度运行,数字货币也应运而生。法定数字货币作为央行发行的具有国家认可效力的数字货币,在我国经济市场上发挥着效率价值、利益实现价值、安全价值、灵活调整价值等重要功能。但由于法定数字货币的监管制度尚未完善,其也存在诸多问题和挑战。在制度层面,法定数字货币存在传统监管模式承载力不足、法律规范体系尚未完善等困境;由于法定数字货币的数字信息化特征,存在个人信息保护领域面临相应风险、围绕数字化技术产生的相关违法犯罪行为缺乏有效规制等问题;在外部层面,法定数字货币的境外流通具有来自国际上的多重阻力。这些困境的化解与问题的解决需要通过法治化手段完善并建设相应制度。At present,the digital economy is in the ascendant in our country.The rise and development of digital economy has changed the application sites,technical means and relevant system operation in the traditional economic field.Digital currency has also emerged at the historic moment.As a digital currency issued by the central bank with the effect of national recognition,legal digital currency plays important functions in China's economic market such as efficiency value,benefit realization value,security value,flexible adjustment value.However,since the regulatory system of legal digital currencies has not yet been improved,it also has many problems and challenges.At the institutional level,legal digital currency has difficulties such as insufficient carrying capacity of traditional regulatory models and imperfect legal normative systems;due to the digital informatization characteristics of legal digital currency,there are corresponding risks in the field of personal information protection and related illegal and criminal behaviors arising around digital technology.On the external level,the overseas circulation of legal digital currency has met multiple international obstacles.The resolution of these dilemmas and the solution of problems requires the improvement and construction of corresponding systems through legal means.
