能动司法观下劳务代偿生态修复方式司法适用和完善--基于63份裁判文书的分析

摘　　要：劳务代偿作为新兴的生态修复责任承担方式,解决了传统生态修复责任的单一性,实现了履行方式的多元化。劳务代偿是司法机关落实以生态环境修复为中心的损害救济制度,并基于时代特性和现实需求积极发挥能动司法的产物。基于对司法裁判案例的分析,劳务代偿在当前的司法实践中仍面临着适用的范围和条件不清、适用标准不一和适用的工作机制不健全的问题。对此需要发挥司法适用的能动性,厘清劳务代偿制度的适用范围和适用条件;发挥司法解释的能动性,统一司法适用的标准;发挥司法行为的能动性,确立和完善劳务代偿工作机制,以促进劳务代偿的司法适用。As an emerging method for ecological restoration responsibility,labor compensation addresses the singularity of traditional ecological restoration responsibilities,achieving diversification in implementation methods.It is an important measure for judicial authorities to actively implement the damage relief system with ecological environment restoration as the core,as well as a response to the characteristics of the times and practical needs.Based on the analysis of judicial cases,labor compensation in the current judicial practice is still facing the problems of unclear scope and conditions of application,different standards of application and unclear working mechanism of application.On this basis,It is necessary to exert the initiative of judicial application,clarify the scope and conditions of application of the labor compensation system;Give full play to the initiative of judicial interpretation and unify the standards of judicial application;Give full play to the initiative of judicial actions,establish and improve the mechanism of labor compensation,in order to promote the judicial application of labor compensation.
