摘 要:减刑假释评估工作有赖于监狱、审判机关、检察机关、社区矫正机构等司法部门各司其职、相互配合、相互制约。实践中,司法部门之间权责不清,导致减刑假释评估运行受阻,假释适用率更是逐年走低。根据《刑法》等法律法规,结合现代刑罚和社会控制理论,明确各司法部门评估职责分工,重构“确有悔改表现”“没有再犯罪危险”“罪犯假释后对社区影响”的减刑假释评估体系是构建权责一致的司法权力运行机制的题中之义。The evaluation of commutation and parole depends on the judicial departments such as prison,judicial organ,procuratorial organ,community correction institution and so on.In practice,the unclear powers and responsibilities among the judicial departments result in the obstruction of the operation of commutation and parole evaluation,and the application rate of parole is decreasing year by year.In accordance with the criminal law and other laws and regulations,and in combination with modern theories of punishment and social control,the division of responsibilities among the judicial departments for evaluation has been clarified,to reconstruct the evaluation system of commutation and parole,such as"true repentance","no risk of reoffending"and"the impact of parole on the community"is the meaning of constructing the operation mechanism of judicial rights.
