摘  要:我国商标审查机关并不限制注册防御商标,但绝大多数防御商标在注册后处于闲置状态,占据商标空间。防御商标注册后未能有效发挥自身防御价值和诉讼价值且面临“撤三”制度检验,处于“有实无名”的尴尬地位。究其根源,防御商标具有保护驰名商标免于抢注的优势激发主体注册动能,我国防御商标的立法缺失和商标审查机关的不限制注册在给予注册空间的同时造成防御商标注册后处于“有实无名”的困境。建立防御商标制度无法解决闲置商标堆积的难题。在强化使用义务的背景下,商标闲置成为亟须解决的问题,此时应继续强化对商标的使用,不建立防御商标制度,及时清理不使用商标以释放商标资源。China's trademark examination authority does not restrict the registration of defensive trademarks,But the vast majority of defense trademarks are unused after registration,which occupy the limited trademark space.Applicants fail to effectively utilize its defensive and litigation value after registering defensive marks.And if defensive marks are not used within three years,they will be withdrawn.The root cause is that the defensive trademark has the advantage of protecting well-known trademarks from being pre-registered,which motivates these applicants to register.However,the lack of defensive trademark system and the practice of unrestricted registration in China have caused difficulties in regulating the defensive trademark.Establishing a defense trademark system will not solve the inherent problem of piling up idle trademarks.In the background of a reinforced obligation to use,idle trademarks have become a problem that needs to be solved urgently.Therefore,it is more important to strengthen the trademark registration back to the purpose of use,do not establish the defense trademark system,and clean up the idle trademarks timely to release trademark resources.
