摘 要:随着全球环保意识和可持续发展理念的日渐增强,环境保护成为全球共同关注的重要议题。在此背景下,环境污染责任保险作为一种环保金融工具,引起全社会广泛关注。在推进“双碳”目标实现的过程中,企业履行环境风险管理职责和承担相应责任显得尤为重要。分析环境污染责任保险的发展状况,对比借鉴欧美等发达国家环境污染责任保险的发展经验,指出当前环境污染责任保险法制建设的困境和趋势:立法仍需要漫长的探索过程,应先完善其政策引导,后实现成熟立法。当前我国环境污染责任保险政策面临诸多困境,如利益主体之间存在信息壁垒、投保责任限额的标准差异较大、环境风险定价机制不完善、经营准入门槛较高等,亟待不断优化,应利用区块链技术打破信息壁垒、尽快建立合理的风险定价模型、建立环境风险准备金和溢价机制、强化社会共治,强化市场监管和执法。With the growing global awareness of environmental protection and the concept of sustainable development,environmental protection has become an important issue of common concern worldwide.In this context,environmental pollution liability insurance,as a financial tool for environmental protection,has attracted widespread attention from the whole society.In the process of promoting the realization of the“Dual Carbon”goal,it is particularly important for enterprises to fulfill their environmental risk management duties and assume corresponding responsibilities.Analyzing the development status of environmental pollution liability insurance,comparing and drawing on the development experience of environmental pollution liability insurance in Europe,America and other developed countries,we point out the current dilemma and trend of the legal construction of environmental pollution liability insurance:the legislation still needs a long exploration process,and it should be perfected firstly by improving its policy guidance,and then by realizing mature legislation.Currently,China's environmental pollution liability insurance policy faces many dilemmas,such as the existence of information barriers between the interested parties,the large differences in the standards of insured liability limits,the imperfection of the environmental risk pricing mechanism,and the high threshold of business access,etc.,which urgently need to be continuously optimized,and should use blockchain technology to break the information barriers,establish a reasonable risk pricing model as soon as possible,build up an environmental risk reserve and premium mechanism,and strengthen the social co-governance,and Strengthen market supervision and law enforcement.
