摘　　要：建构主体性的政治法律知识体系需即事言理、从实求知,通过把握真实的历史社会现实,进行深入的内在理解,在此基础上发现规律、提炼概念、概括命题、建构理论。社会科学知识源自对社会的认知,社会的实存性与人文性决定了需在观察和理解的基础上把握真的现实与历史,主体性的社会科学知识要与其所在世界建立真实联系。经济学基于对中国经济实践的考察出现了研究的中国转向,社会学则进一步从中国转向走向历史转向、文化转向。政治法律理论也应如此。中国国家治理有着自身的制度逻辑与历史逻辑,也受文化观念深刻影响,它们是主体性政治法律知识的重要来源。这一进路也要面向真实的问题和未来发展方向,处理好政治法律中的规范性问题,不舍弃中外比较的视野,它也为破解古今中西之争提供了理论可能。Constructing an autonomous political and legal knowledge system with Chinese characteristics requires formulating theory from practice and seeking knowledge from China's reality.By grasping the real historical and social reality and conducting in-depth internal understanding,it is possible to discover patterns,extract concepts,generalize propositions,and construct theories based on this foundation.Knowledge in the social sciences originates from an understanding of society,and the existential and humanistic nature of society determines that only by observing and understanding the social reality can one grasp the true reality and history.Social scientific knowledge with Chinese characteristics needs to establish a genuine connection with the world in which it exists.Economics,based on an examination of China's economic practices,has shifted its focus to the study of China,while sociology has further shifted its focus from Chinese society to the history and culture.Political and legal theory should follow suit.China's national governance has its own institutional and historical logic,deeply influenced by cultural concepts,which are important sources of the autonomous political and legal knowledge system with Chinese characteristics.This approach also needs to address real issues and future directions,handle normative issues in political and legal matters,retain the comparative perspective between China and foreign countries,and provide theoretical possibilities for resolving the conflicts between ancient and modern,East and West.
