摘 要:目的:当前在市场监管实践中,对商标侵权行为的判定是基于取证证据,由执法人员根据相关法律进行人工判定,这样做存在周期长、人为主观判定不准确等问题。故研究商标侵权行为的数字化辅助判定以提高商标侵权案件的行政执法效率。方法:首先通过分析大量商标侵权案件,在粗糙集框架下,提取商标侵权案件违法行为所需的核心要素作为评价指标,给出指标的取值规则,并结合Pearl因果推理模型为指标赋权值。结果:在构建的评价指标体系和决策表的基础上,形成了商标侵权行为的数字化辅助判定方法,实现了从原始证据到商标侵权行为的直接识别。结论:通过应用实践案例证明,所构建的数字化辅助判定方法依据收集的证据能够快速给出判定结果供执法人员参考,且该方法模型易于计算机语言实现,便于数字化、智能化执法系统集成开发,将会促进市场监管效能提升。Aims:In the current market supervision practice,the determination of trademark infringement is based on evidence collection and determined by law enforcement personnel according to relevant laws,which has the problems such as long cycles and inaccurate subjective judgments.The paper studies the digital responsible judgment of trademark infringement behavior to improve the administrative enforcement efficiency of trademark infringement cases.Methods:To improve the administrative enforcement efficiency,a large number of trademark infringement cases were first analyzed under the rough set framework.Then the core factors needed to identify the illegal behavior in the cases were extracted as evaluation indexes.Meanwhile,the rules of taking the value for each indicator were given.By combining with Pearl s causal inference model,the weights were assigned to every indicator.Results:Based on the built evaluation index system and decision table,the digital assisted determination method of trademark infringement was constructed,which realized the direct identification from the raw evidence to the trademark infringement.Conclusions:The application practice proves that the method can quickly give judgment results based on the collected evidence for the reference of law enforcement officers.And the method is easy to program and develop the intelligent law enforcement system.It further promotes the enhancement of market supervision efficiency.
