摘 要:《民法典》第一千二百二十条关于紧急医疗救治的规定是对患者知情同意权的异变,即医疗机构在紧急情况下无法取得患方意见,经审批程序即可立即实施相应的医疗措施,这将最大限度保障急危患者的生命健康。但是在实施过程中,人们对这一制度的理解存在分歧,同时制度设计本身也存在缺陷。准确界定紧急医疗救治的性质,研究“经医疗机构负责人同意”程序是否与紧急医疗救治的性质适配,分析医疗机构在紧急情况下对患者近亲属身份是否负有识别义务以及负有怎样的识别义务,将对发挥紧急医疗救治制度的价值具有重要的理论和实践意义。Article 1220 of the Civil Code on emergency medical treatment is an abnormality of the patient's right to informed consent,that is,if a medical institution cannot obtain the opinion of the patient in an emergency,the corresponding medical measures can be implemented immediately after the approval procedure,which will protect the life and health of the critically ill patient to the greatest extent.However,in the process of implementation,peo-ple's understanding of this system is different,and the system design itself has shortcomings,accurately defining the nature of emergency medical treatment,studying whether the procedure"with the consent of the person in charge of the medical institution"is suitable for the nature of emergency medical treatment,and analyzing whether medical in-stitutions have the obligation to identify the identity of patients'close relatives in emergency situations and what kind of identification obligations they have,which will have important theoretical and practical significance for giving play to the value of the emergency medical treatment system.
