摘　　要：推动中医药传统知识保护与现代知识产权制度有效衔接,进一步完善中医药知识产权综合保护体系,是促进中医药传承创新发展的关键所在。当前我国中医药知识产权保护已初成体系,然而由于中医药的自身特性,现有制度下中医药知识产权保护正面临困境。我国应借鉴域外法中已趋于成熟的传统医药知识产权保护经验,推进中医药知识产权专门立法、建立国有处方资源库制度、设立中医药专利特殊保护期制度、改进专利权授予流程,促进中医药知识产权创新发展。The key to promoting the inheritance and innovation of Traditional Chinese Medicine(TCM)is to ef-fectively link the protection of TCM knowledge with the modern intellectual property system and further improve the comprehensive protection system of TCM intellectual property.At present,TCM intellectual property protection system has been established.However,due to the characteristics of TCM,the protection of TCM intellectual prop-erty under the existing system is facing difficulties.We should learn from the mature experience of intellectual prop-erty protection in TCM in foreign law,advance special legislation on intellectual property of TCM,establish a re-source library system for state-owned prescription,establish a special protection period system for patent of TCM,improve the patent granting process,and promote the innovative development of intellectual property of TCM.
