由无证行医的违法行为模式谈法律适用处罚时效和违法所得问题

摘　　要：伴随着《中医药法》《基本医疗卫生与健康促进法》《医师法》的相继出台和《医疗机构管理条例》的再次修改,多部法律法规涉及无证行医这一违法行为,适用中存在多项法律竞合。通过梳理上述法律法规中关于无证行医处罚的条款,分析不同形式的无证行医违法行为的法律适用,探讨无证行医的行政处罚时效和违法所得的没收和认定等法律问题。With the promulgation of Law of the Traditional Chinese Medicine,Law of the Basic Healthcare and Health Promotion,and Law of Medical Practitioners,and the revision of the Regulation on the Administration of Medical Institutions,many laws and regulations involve the illegal practice of medicine without license,and there are many coincidence of Articles in the application.Through combing the provisions of the above laws and regulations on the punishment of practicing medicine without license,this article analyzed the legal application of different forms of illegal acts of practicing medicine without license,and discussed the legal issues such as the statute of limitations of administrative punishment and the confiscation and recognition of illegal gains.
