摘 要:作为一种外来宗教,天主教在康熙朝经历了“禁教—容教—再禁教”的剧烈动荡。鉴于这种典型性,研究者要么从文化冲突视角,要么从政治分析角度研究康熙朝容教与禁教问题。如果结合在华耶稣会士相关史料记载,可以发现这些容教与禁教决定的作出都是围绕着相关案件展开,其处理过程都是依托着清初相关法律制度背景设计进行的。清廷对于天主教相关问题的法律规定和法律适用是康熙朝容教与禁教决定出台的基准点。对于康熙朝容教与禁教问题的研究不能脱离“司法视角”展开。As a foreign religion,Catholicism went through a violent upheaval of"prohibition-tolerance-re-prohibition"during the Kangxi period.Based on this typicality,researchers have studied the issue of tolerance and prohibition of Catholicism during the Kangxi period ei-ther from the perspective of cultural conflict or from the perspective of political analysis.How-ever,if combined with the historical records of the Jesuits in China,it can be seen that the de-cisions on tolerance and prohibition of Catholicism were made in the context of the relevant reli-gious cases,and the process was designed in the context of the legal system of the early Qing Dynasty.The legal provisions and the legal application system of the Qing government on Ca-tholicism issue were the central point of the decisions making on tolerance and prohibition dur-ing the Kangxi period.Therefore,the study of the tolerance and prohibition of Catholicism dur-ing the Kangxi period cannot be conducted without a judicial perspective.
