摘 要:随着法治环境的日趋成熟,行政规范性文件在制定、实施和监督过程中,面临着一系列严峻挑战,如繁杂的制定程序、缺乏有效的实施保障和公众参与、以及监督机制的不健全等。本研究从行政法学的视角,通过回顾行政规范性文件的发展历程和法理定位,然后从事前、事中和事后三个阶段,系统地分析了中国行政规范性文件监督体系存在的问题。本文的研究不仅有助于推动我国行政监督体系的改革和发展,提高行政效率和公正,同时也为更好地实现行政规范性文件的规制目标提供了有益的理论指导和实践参考。With the increasing maturity of the rule of law environment,administrative normative documents are faced with a series of severe challenges in the process of formulation,implementation and supervision,such as complicated formulation procedures,lack of effective implementation guarantee and public participation,and imperfect supervision mechanism.From the perspective of administrative law,this study systematically analyses the problems of China’s administrative normative document supervision system by reviewing the development history and jurisprudential orientation of administrative normative documents,and then by engaging in the three stages of ex-ante,in-process and post-event supervision.The research in this paper not only helps to promote the reform and development of China’s administrative supervision system,and improve administrative efficiency and fairness but also provides useful theoretical guidance and practical reference for better realizing the regulatory objectives of administrative normative documents.
