网络诽谤立法的时代意义及其完善建议

摘　　要：互联网的普及和社交媒体的迅猛发展让各类主体参与到一个逐渐完善的网络社交世界中去,随着公众主权意识特别是言论自由权利的在网络世界的提倡,导致网络诽谤现象日益严重,对个人名誉、社会秩序乃至国家法治建设造成了不良影响。因此,为保护公民权益和治理网络社交环境,网络诽谤立法应运而生。本文首先概述了网络诽谤立法的现状,分析了其维护社会和谐稳定、保护公民合法权益、促进网络空间健康发展以及提升国家法治水平方面的时代意义。同时本文进一步论证了完善网络诽谤立法的必要性和可行性。但现行网络诽谤法律规范仍存在着一些现实问题,如立法滞后于网络发展、法律责任界定不明确等。针对这些问题,本文提出了完善网络诽谤立法的建议,为营造文明合规的网络环境提出见解。The popularity of the Internet and the rapid development of social media have made all kinds of subjects participate in a gradually improved online social world.With the promotion of public so-vereignty awareness,especially the right to freedom of speech,online defamation has become in-creasingly serious,which has had a negative impact on personal reputation,social order and even the construction of the national rule of law.Therefore,to protect the rights and interests of citi-zens and regulate the online social environment,online defamation legislation has emerged.This article first outlines the current state of online defamation legislation,analyzing its significance in maintaining social harmony and stability,protecting the legitimate rights and interests of citizens,promoting the healthy development of cyberspace,and enhancing the level of national rule of law.This article further demonstrates the necessity and feasibility of improving legislation on online defamation.However,there are still some practical problems in the current legal norms for online defamation,such as legislation lagging behind the development of the internet and unclear defini-tions of legal responsibility.In response to these issues,this article proposes suggestions for im-proving legislation on online defamation,offering insights into creating a civilized and compliant online environment.
