交通警察行政权失范与规制——基于交警行政诉讼裁判文书的实证分析

摘　　要：交通警察(以下简称交警)行政诉讼是法院公开审理和裁决交警行政争议来监督交警行政权的制度。裁判文书在互联网上予以公布,对实证法学研究提供前所未有的契机。以此为契机通过交警行政诉讼败诉案例来研究交警行政权失范是一种特殊的视角。文章以中国裁判文书网、威科先行法律信息库等平台为依托,对交警行政诉讼裁判文书数据进行整理,将交警行政诉讼败诉理由等内容归纳和分析,发现:交警行政诉讼案发量高,败诉率从2020年开始持续增长,同时呈现出原告撤诉率较高等现象。结合各相关因素,交警行政权失范受内部、外部和社会三个层面因素影响。基于问题导向,交警行政权失范规制可以采取加大法院对撤诉案件的审查力度、立法调控,绝对服从宪法法律保留原则、扩大程序的“能见度”、建立惩治机制和借鉴优质实践经验举措等措施。Traffic police(hereinafter referred to as traffic police)administrative litigation is a system of supervising the administrative power of traffic police by the court's public hearing and adjudication of traffic police administrative disputes.The adjudication documents are published on the Internet,which provides an unprecedented opportunity for empirical legal research.It is a special perspective to study the misconduct of traffic police's administrative power through the cases of traffic police's administrative litigation failure.Based on the platforms of China Judgment Net and WK Advanced Legal Information Database,the article organizes the data of traffic police administrative litigation judgments,summarizes,and analyzes the reasons for traffic police administrative litigation,and finds that:the number of traffic police administrative litigation cases is high,and the rate of defeat has been increasing since 2020,and at the same time,it presents the phenomenon of high rate of withdrawal of plaintiffs.Combined with the relevant factors,the traffic police administrative power failure is affected by the internal,external,and social factors at three levels.Based on the problem-oriented,the traffic police administrative power misconduct regulation can be taken to increase the court's review of the withdrawal of cases,legislative regulation,absolute obedience to the principle of reservation of constitutional law,expanding the visibility of the procedure,the establishment of a punitive mechanism,and learn from high-quality practical experience and other measures.
