档案犯罪的滋生原因和治理对策研究——基于31个档案犯罪案件的分析

摘　　要：通过对31个档案犯罪案件进行分析发现,档案犯罪呈现行为主体普通民众居多、作案动机比较简单、处罚比较轻缓等特点。档案犯罪的滋生原因在于对档案犯罪的惩治不够及时、高效,未对档案违法犯罪分子形成有力威慑,相关档案管理制度不完善,档案管理制度未得到严格执行,档案违法犯罪分子法律意识淡薄,档案保护意识欠缺等。提出有效预防和治理档案犯罪的若干建议包括构建档案违法犯罪行刑衔接机制为核心完善执法司法,增强查处档案违法犯罪力度;完善相关制度漏洞为核心织密管理制度网络,严防档案违法犯罪滋生;以法治教育为核心守牢底线,增强民众法律意识和档案保护意识;优化社会公共政策为核心筑牢保障底线,加强社会弱势群体的社会支持力度。Through the analysis of twenty cases of archival crimes,it was found that the majority of the perpetrators of archival crimes are ordinary people,the motives for committing crimes are relatively simple,and the punishment is relatively mild.The reason for the breeding of archival crimes is that the punishment for archival crimes is not timely and efficient enough,and there is no strong deterrence for archival criminals.The relevant archival management system is not perfect,and the archival management system is not strictly enforced.The legal awareness of archival criminals is weak,and there is a lack of awareness of archival protection.Based on empirical research,several suggestions for effective prevention and governance of archival crimes are proposed:with the construction of a linkage mechanism for the execution of archival crimes as the core,improve law enforcement and justice,and strengthen the investigation and punishment of archival crimes;Organize a network of management systems with the core of improving relevant institutional loopholes,and strictly prevent the breeding of illegal and criminal archives;Adhere to the bottom line with rule of law education as the core,and enhance the public's legal awareness and archive protection awareness;Building a solid guarantee bottom line with optimizing social public policies as the core,and strengthening social support for vulnerablegroups in society.
