摘　　要：市场自然属性是指发明创造、运用和寻求保护是人类在生产和生活实际中应对生存与进步的生命本性,也是人的自然特征,不存在外因作用也能随市场需求而自然进步发展。发明创造是自然人寻求克服困难、提高劳动效率和改善生活质量的本能,把发明创造应用于生产和生活中,也是人们实现发明创造目的的自觉行为,将发明创造成果通过一种方式,如获得专利证书而得到社会和国家的认可同样是人的本性需求,无需其他因素影响和干预。基于对专利制度的起源、沿革和市场机理进行深度分析,探讨专利制度的自然属性及其内涵,分析政府、市场以及专利制度三者之间的内在联系,得出专利制度应该遵循人的本能属性并符合市场经济自然发展的社会调节规律,不需要过多的外因干预,方能健康有序地推进。The natural attributes of markets refers to the fact that invention,creation,utilization and seeking protection are the nature of life of human beings to cope with survival and progress in production and life practice,as well as the natural characteristics of human beings,which can progress and develop naturally along with the market without the function of exogenous factors.That is to say,invention is the natural man's instinct to seek to overcome difficulties and improve the efficiency of his labor,and the application of invention to production and life is also a conscious act of mankind to realize the purpose of invention.It is also in the nature of human beings to have the results of their inventions recognized by society and the State in a manner such as obtaining a patent certificate,without the need for other factors to influence or intervene.Based on in-depth analysis of the origin,evolution and market mechanism of the patent system,exploring the natural attributes of the patent system and its connotations,analyzing the interconnections between governments,markets and patent systems,it is concluded that the patent system should be in line with the law of automatic regulation of the development of the market economy,and promote its development in a healthy and orderly manner without needing too much external intervention.
