摘　　要：目前智慧图书馆建设中未成年读者个人信息保护仍面临诸多问题,《公共图书馆法》与《个人信息保护法》缺乏必要协调导致未成年读者信息保护层次不清,监护人知情同意制度难以落实,多元的信息处理者与信息处置化解导致读者信息面临风险异常升高,都导致未成年读者信息保护陷入真空地带。新时代图书馆建设中应当把握住未成年读者信息的动态与规模化特征,明确信息支配关系中的主体关系,通过完善未成年读者信息的分级保护机制,并通过信息撤回权、删除权、集体协商机制提升知情同意制度运作效果,同时建立起一整套防范利益冲突与信息泄露的合规机制,提升未成年读者信息保护的实效。At present,the protection of personal information of minor readers in the construction of smart libraries is still facing many problems.The lack of necessary coordination between the Public Libraries Law and the Personal Information Protection Law has led to the unclear level of the protection of minor readers’information,and it is difficult to implement the system of the guardian’s informed consent,and the risk of readers’information being exposed to an abnormally high risk due to the diversified information processors and the resolution of information disposal has led to the protection of minor readers’information being caught in a vacuum.During the library construction in the new era,we should grasp the dynamic and large-scale characteristics of underage readers’information,clarify the subject relationship in the information domination relationship,improve the hierarchical protection mechanism of underage readers’information,and enhance the operation effect of the informed consent system through the right of information withdrawal,the right of deletion and the mechanism of collective negotiation.At the same time,we should establish a complete set of compliance mechanism to prevent conflict of interest and information leakage,so as to enhance the effectiveness of underage readers’information protection.The effectiveness of information protection for underage readers is also improved by establishing a set of compliance mechanisms to prevent conflict of interest and information leakage.
