效益到权利:数字经济构建的非均衡性及法治矫正

摘　　要：当前我国数字经济构建蕴含着数据要素驱动的市场化、数字GDP提升的指标化与数字设施普及的效率化逻辑,“效益”成为数字经济构建的价值基础。在效益价值支配下,数字经济构建呈现出明显的“非均衡性”困境,即数据要素过度集中与垄断,数字资本导致个人主体性消解,横向与纵向数字鸿沟对个人融入数字生活形成了侵扰。鉴于此,应立足共享型法治的基本理念,实现对数字经济构建的矫正。数字经济构建应秉持“权利”立场,通过数字防御权、数字参与权、数字平等权的树立以实现对效益价值的扭转。具体而言,应加强法律监管与保障以防止数据过度集中,提升制度伦理以增进数字福祉,构建普惠化机制以破解数字鸿沟,从而从整体上促进数字经济构建向人性价值的回归。The current digital economy construction in China contains the marketization logic driven by data factor,the indexation logic of digital GDP promotion and the efficiency logic of popularization of digital facilities.“Benefit”has become the value basis of the digital economy construction.Under the domination of benefit value,the digital economy construction presents an obvious non-equilibrium dilemma,that is,excessive concentration and monopoly of data factor,digital capital leads to the dissolution of individual subjectivity,and the horizontal and vertical digital divide intrudes the individual’s integration into the digital life.In view of this,the digital economy construction should be corrected based on the shared rule of law.The digital economy construction should uphold the position of“rights”and realize the reversal of benefit value through the establishment of digital defense rights,digital participation rights and digital equality rights.Specifically,legal regulation and protection should be strengthened to prevent excessive data concentration,institutional ethics should be improved to enhance digital well-being,and a universal mechanism should be constructed to bridge the digital divide,so as to promote the return of digital economy construction to human values.
