摘　　要：数字平台营造封闭型数字生态强化了网络效应、锁定效应等平台经济特性,破坏了交易的公平性,给交易相对人带来了显著不利益,影响社会财富的初次分配,需要加强反垄断规制。生态系统封闭效应显著的应用商店为剥削性滥用的生成与反垄断规制提供了一个绝佳观察模版。应用商店剥削性滥用的完整画像与其双边市场结构具有内在一致性,不仅包括实践中热议的开发者侧佣金过高问题,还包括消费者侧过度收集、处理数据问题。单一的事后执法对“数据型剥削”和“结构性市场失灵”的因应不足是传统反垄断规制的痼疾。反垄断规制工具的创新,既要完整涵盖双边市场的异质剥削,又要跟上技术创新与商业模式的发展变化——事前加强竞争倡导,强化应用商店自我管理和自我规范;事中重视行业调查,深入了解应用商店服务市场的竞争状况、市场结构以及垄断力量的存在程度;事后开展对数据型剥削性滥用的定量分析,打造“事前+事中+事后”全链条反垄断规制体系。Digital platforms create closed digital ecosystems that enhance network effects and lock-in effects,exacerbating the fairness of transactions,causing significant detriment to trading counterparts,and affecting the initial distribution of social wealth,necessitating strengthened antitrust regulation.App stores,with their pronounced ecosystem closure effects,offer an excellent model for observing exploitation abuses and antitrust regulation.The comprehensive view of exploitation abuses in app stores aligns with the bilateral market structure,encompassing not only the highly debated issue of excessive commissions on the developer side but also the excessive collection and processing of data on the consumer side.Traditional antitrust regulation’s chronic issue is the inadequacy of single ex-post enforcement in addressing“data exploitation”and“structural market failures.”Innovation in antitrust regulation tools must comprehensively cover the heterogeneous exploitation in bilateral markets and keep pace with technological innovations and changes in business models.This includes strengthening competition advocacy ex-ante,enhancing self-management and self-regulation of app stores;focusing on industry investigations mid-process to deeply understand the competitive status,market structure,and the extent of monopoly power in the app store services market;and conducting quantitative analysis of data exploitation abuses ex-post,thereby creating a full-chain antitrust regulation system of“ex-ante+mid-process+ex-post”.
