《中华人民共和国精神卫生法》中约束措施的完善路径

摘　　要：根据治疗需要,精神卫生医疗实践中往往会采用一定的约束措施。作为一项运用频率较高的医疗措施,因其具有一定的特殊性和复杂性,且容易引发医疗纠纷,因此,约束措施的完善,即提高其严谨性、规范性与准确性就显得尤为重要。本文围绕《中华人民共和国精神卫生法》第40条医疗机构实行约束措施的内容,对约束对象的范围、可替代措施和约束时间的确定等问题进行了相关的探讨,指出立法中约束措施规定存在的不足之处,并在此基础上对约束行为对象的范围界定、可替代措施的发展和完善约束时间的评估和记录三方面提出了相应的对策。In order to meet the medical needs,certain restrictive measures are often adopted in the practice of mental health care.As a medical activity with high application frequency,it has certain particularity and complexity,and it is easy to cause medical disputes.Therefore,it is particularly important to improve the restraint measures and improve its rigor,standardization and accuracy.Based on Article 40 of the Mental Health Law,the scope of the constraint object and the determination of the constraint time are discussed in this paper.The deficiencies of the regulation of restraint measures are pointed out in this paper,and on this basis,puts forward some countermeasures in the aspects of the definition of the object of restraint behavior,the improvement of alternative measures and the recommendation of the evaluation and record of restraint time.
