医疗纠纷案件中责任竞合的现状及对策

摘　　要：我国医患关系紧张的一个重要原因是医疗纠纷案件发生后的法律救济复杂化,特别是由于不同患者面对专业诉讼中违约责任和侵权责任竞合时的不同诉讼选择,造成了在现实中部分患者法律救济的不充分、不及时。为解决这一现实问题,笔者利用判决书统计分析法,厘清当今医疗纠纷案件中责任竞合的真实现状与不同诉讼选择的区别,针对医疗纠纷案件中责任竞合所引发的法律困境,创新性地通过实体法与程序法双重视角,重新解读《中华人民共和国民法典》第996条,并主张该条为诉的合并理论在实体法上的体现,提出以诉的客观预备合并作为医疗纠纷案件中的责任竞合问题处理模式,为解决我国医疗纠纷案件中责任竞合这一医学界和法学界的共同困境提供解决方法。An important reason for the tensions between doctors and patients in China is that the legal remedies are complex after the medical disputes arise.Add to this,patients may take different paths to litigate in the situation where contractual and tort liabilities overlap,and this has led to insufficiency and delay in legal remedy for some patients in practice.In order to deal with this problem that bears significant practical?urgency,the article includes a statistical analysis of a group of sample court judgments in order to have a comprehensive understanding of the context and the litigation options available for the parties.As to the legal dilemma caused by liability concurrence in medical dispute cases,this article argues from the perspectives of both substantive and procedure laws and relies upon the reinterpretation of Article 996 of the Civil Code of the People’s Republic of China,which led to the final suggestion that the consolidation of litigation in the substantive law,and that objective preliminary joinder of actions is the solution to the problem of liabilities concurrence,and this new model is expected to be inspiring in solving the problem of liability concurrence which have puzzled both medical and legal fields in our country.
