摘　　要：品种权作为知识产权的一种,其保护与实施日益受到重视。品种权旨在鼓励植物新品种的创造与推广,以促进农业科技进步和生产提升。然而,品种权的加强保护也给农户利益带来了影响,尤其在发展中国家和农业大国更为明显。本研究旨在分析品种权的法律基础,其对农户利益的影响以及在中国的实施情况。研究发现,虽然国际和国内法律对品种权提供保护,但农户的权益往往未得到充分保障。本研究进一步探讨了农户在品种权纠纷中的法律地位和保护不足问题,最后提出了法律调和路径,包括加强法律机制、提升农户参与度和建立有效的纠纷解决机制。研究认为,通过优化品种权管理、强化政策保障和国际合作,可以实现品种权保护与农户利益的有效平衡,促进农业可持续发展。Plant variety rights,as a form of intellectual property,have increasingly garnered attention for their protection and implementation.These rights aim to encourage the creation and promotion of new plant varieties,thus fostering progress in agricultural science and production enhancement.However,the intensified protection of plant variety rights has impacted the interests of farmers,especially in developing countries and agricultural powerhouses.This study aims to analyze the legal basis of plant variety rights,their impact on farmers'interests,and their implementation in China.The research finds that although international and national laws protect plant variety rights,the interests of farmers are often not adequately safeguarded.The paper further explores the legal status and insufficient protection of farmers in disputes over plant variety rights,and finally proposes a path for legal harmonization,including strengthening legal mechanisms,enhancing farmer participation,and establishing effective dispute resolution mechanisms.The study suggests that by optimizing the management of plant variety rights,reinforcing policy support,and enhancing international cooperation,a balance can be achieved between the protection of plant variety rights and farmers'interests,thereby promoting sustainable agricultural development.
