摘　　要：情报主导警务理念推动传统侦查模式向情报主导侦查模式转型。但情报主导侦查模式在运行过程中,由于缺乏理论、制度以及规则的约束,侦查活动日益接近情报活动,进而导致侦查机关在侦查对象设定、手段运用、程序选择等方面缺乏必要规制,引发取证对象弥散化、运行自动化、手段隐秘化、程序虚置化、个体被无差别地同质化对待,进而导致公民权利遭受不当干预等一系列风险。在侦查情报化背景下,技治时代的刑事司法应当注意防范技术治理可能被滥用或泛化使用的倾向,对技术治理进行再治理;同时,还应当从国家治理体系和治理能力现代化的角度对因应技治时代的主动预防理念进行纠偏,实现赋能国家治理与赋权公民权利的统一。The intelligence-led policing concept is driving the transformation of traditional investigative models towards intelligence-led investigative approaches.However,in the operational process of intelligence-led investigations,the lack of constraints theoretical frameworks,institutional structures,and regulations has led investigative activities to increasingly resemble intelligence operations.This has given rise to intelligence-resembling investigations,leading to a lack of necessary regulations in the investigative organs in the setting of the target identification,methods usage,procedural selection and etc,triggering the dispersion of targets,automation of operations,covert methods,and the virtualization of procedures,and individual are indiscriminate homogeneity which lead to civil rights suffer improper intervention and a series of risks.etc.In the context of investigative intelligence,the criminal justice in the technology era should pay attention to the tendency that technology governance may be abused or generalized,and reuse technology governance;Meanwhile,from the perspective of modernizing the national governance system and capabilities,there is a need to rectify the proactive prevention ideology in response to the era of technical governance.This involves aligning the empowerment of national governance with the empowerment of citizens'rights.
