信息化时代“警企合作”对行政组织法的挑战——从规范主义到功能主义

摘　　要：信息化时代多元的公共利益亟须保护,行政任务不断增加,囿于自身在人员配置与技术上的劣势,公安机关不得不寻求私人合作,以多样的“警企合作”方式完成行政任务。当私主体履行传统上被认为专属于国家的职能时,势必会对秉持“依法律支配行政”理念的传统行政组织法带来前所未有的挑战。以行政任务为介入点的“功能主义”理论是否能突围由传统“规范主义”理论构建的行政组织法给“警企合作”带来的制度困境,前提就要论证私主体承担行政任务的合法性,以此为前提构建“警企合作”的组织方式。In the information age,diversified public interests need to be protected urgently,and administrative tasks are increasing.Due to the disadvantages in terms of staffing and technology,public security organs are forced to seek private co-operation,and to fulfill administrative tasks in various ways through"police-enterprise co-operation".When private subjects perform functions traditionally regarded as belonging exclusively to the state,it will inevitably bring unprecedented challenges to the traditional administrative organizational law,which upholds the concept of"law-governed administration",and whether the"functionalist"theory,which takes administrative tasks as the point of intervention,will be able to break through by the traditional"normativist"theory.Whether the"functionalist"theory of administrative tasks can break out of the institutional dilemma brought about by the traditional"normative"theory of administrative law to"police enterprise cooperation",the premise is to prove the legitimacy of the private subjects to undertake administrative tasks,and as a premise to build"police-enterprise co-operation".The premise is to prove the legitimacy of administrative tasks undertaken by private subjects,and to construct the organizational method of"police-enterprise cooperation"on this premise.
