摘 要:通过介绍“一事不再罚”的理论基础和实践价值,用案例的方式剖析“一事不再罚”在海事行政处罚实践中的具体适用和判断标准。认为“一案多罚”基于共同违法行为理论,不视为违法“一事不再罚”;“同一违法行为”的认定应当在确定符合法律规范的要件之后,辨析是否属于连续或继续状态、想象竞合的情形,综合判断“一事”;“择一重罚”规则进一步为“不得两次罚款”的适用提供了指引,在具体案件中应当适用法定处罚额度高的法律规范。This article introduces the theoretical basis and practical value of the"no one should be twice punished for the same cause",analyzes through case studies its concrete application and definition in maritime administrative practices.The paper is of the view that"multiple penalties in one case"based on the joint illegal acts theory should not be regarded as violations of the"no one should be twice punished for the same cause"principle."the same offense"should be recognized only after establishing compliance with legal norms,distinguishing between continuous or concurrent status and imaginative joinder of offenses,and comprehensively concluding to the establishment of"one incident."The"imposition of the most severe of the punishment"principle provides guidance for the application of the"no more punishment for the same cause"principle and should mean adhering to the higher statutory penalty limits in specific cases.
