摘 要:随着海洋强国战略目标的提出和“一带一路”建设的逐步推进,国际货物多式联运以其多样的运输方式实现了国际货物运输的便捷与高效,突出了其独特的优势。国际货物多式联运途经多个国家或地区,货物灭失、损坏可能发生在某一国家或地区,因法律制度的差异,责任认定适用哪个国家或地区的法律,对多式联运各方当事人的利益影响较大。基于此,从多式联运经营人责任如何运用法律进行确定的角度出发,对我国多式联运的进一步发展提出相关建议。With the proposal of the strategic goal of becoming a maritime power and the gradual progress of the construction of the"the Belt and Road",the international multimodal transport of goods has realized the convenience and efficiency of international cargo transport with its various transport modes,highlighting its unique advantages.The international multimodal transportation of goods passes through multiple countries or regions,and the loss or damage of goods may occur in a certain country or region.Due to differences in legal systems,the determination of responsibility applies to which country or region's law,which has a significant impact on the interests of the parties involved in multimodal transportation.Based on this,from the perspective of how to determine the responsibility of multimodal transport operators through legal means,relevant suggestions are proposed for the further development of multimodal transport in China.
