对接CPTPP视域下我国数字版权的刑事保护:规则检视、模式转向与路径优化

摘　　要：CPTPP在数字版权的刑事保护方面做出了高水平的示范,对数字版权犯罪保护客体进行大幅度扩容,在新型数字版权侵权行为犯罪化方面进展超前,删除数字版权侵权犯罪中的获利目的要件,降低了数字版权侵权犯罪入罪门槛。为对接CPTPP,我国数字版权刑事保护要转向精细化分类保护模式,转向直接保护与间接保护模式相结合模式,转向以事前预防为主、事后惩治为辅的全新模式。为达到CPTPP数字版权刑事保护的高标准,我国应通过设置空白罪状的方式进一步扩大数字版权侵权犯罪圈,建立与数字平台的协同合作机制,提高数字版权犯罪线索移送与数字证据获取的效率,遵守罪刑相适应原则精准赋刑,实现罪刑对称与罪刑均衡,释放刑法的数字版权保护效能,为后续加入CPTPP谈判提供刑法领域数字版权保护改革具体清单,为数字版权侵权犯罪这一全球性犯罪的治理提供高质量的“中国方案”。Multilateral treaties CPTPP accomplishes a series of high-quality demonstrations in digital copyright crime governance and protection.It greatly enlarges the digital copyright criminal protection objects,progresses far ahead in the criminalization of new type digital copyright infringements,removes the profit objective elements for digital copyright infringement crimes,and lowers the criminalization thresholds of digital copyright infringement crimes.For a better coordination with CPTPP,Chinese digital copyright criminal protection needs a turning to finely classified protection modes,to a combination of direct and indirect protection modes,to a precaution-dominated and punishment-supplemented mode.To meet the high standards of CPTPP digital copyright criminal protection rules,China should further enlarge its digital copyright infringement circle by setting up blank crimes.It is necessary to found a coordination mechanism with digital platforms,so as to increase efficiency in digital copyright infringement clue submission and digital proof obtaining.The principle of crime-punishment suiting should be well applied for a precise crime penalty,crime-punishment symmetry and balance.The release of this protection function in criminal laws for digital copyright protection would provide a specific list of digital copyright protection reforms in the criminal law field for subsequent negotiations on China’s joining CPTPP treaty.This would also provide high-quality“Chinese solutions”for this worldwide digital copyright infringement crime governance.
