不起诉案件行刑反向衔接的实践思考与完善进路——以63件不起诉案件为研究对象

摘　　要：检察机关对于作出不起诉决定的案件,向行政执法机关移送行政处罚案件的反向衔接制度,是强化行刑衔接配合,共同推进法治中国建设的重要内容。作为一种“后置型”的犯罪治理模式,行刑反向衔接不仅能够填补不起诉决定作出后“不诉了之”所留空白,还有助于形成多元化的社会风险治理体系。其背后折射出从重刑轻行向行刑衔接转型、行政机关与司法机关“配合制约”、治理犯罪与预防犯罪并重等逻辑。但在实践中,行刑反向衔接工作出现了行政处罚时效判断标准不一、内外部移送缺乏明确规定、被不起诉人和被处罚人的定位混乱、存在不刑也不罚追责盲区等问题。因此有必要分析当前行刑反向衔接实践工作中存在的难点及原因,进而在制度设计、平台建设、统筹协调等方面完善行刑反向衔接机制。The reverse linkage system of deciding not to prosecute cases and transferring administrative penalty cases to administrative law enforcement agencies is an important part of strengthening the coordination of execution and jointly promoting the construction of a rule of law in China.As a"backward"crime governance model,the reverse connection of execution can not only fill the gap left by the decision to not prosecute but also help form a diversified social risk governance system.It reflects the logic of transitioning from heavy punishment and light punishment to execution,coordinating and constraining administrative and judicial organs,and placing equal emphasis on crime governance and prevention.In practice,the reverse connection of execution has encountered problems such as inconsistent standards for determining the statute of limitations of administrative penalties,lack of clear provisions for internal and external transfers,confusion in the positioning of non prosecuted and punished individuals,and blind spots in the pursuit of punishment without punishment.Therefore,it is necessary to analyze the difficulties and reasons in the current practice of reverse execution linkage,and improve the mechanism of reverse execution linkage in terms of system design,platform construction,and overall coordination.
