西南彝区“大调解”体系的现状及改进对策——以楚雄彝族自治州为例

摘　　要：西南彝区的“大调解”体系是一种解决基层社会矛盾纠纷的机制,是对“枫桥经验”的继承和发展。地处西南彝区的云南省楚雄彝族自治州各县市在积极探索“大调解”体系的实践中形成了各具特色的做法,取得了显著成效,但仍存在共性层面和个性层面的不足,如全国性法律支持不足,与国家司法体系衔接不畅,习惯法与国家法存在冲突,资源配备不足,社会认同度不高,案件处理效率有待提高,“双语调解员”“双语法官”数量不够等。为此,西南彝区的“大调解”体系应与诉源治理、基层社会治理相结合,加强调解组织和调解员队伍建设,以便为西南彝区社会的和谐与稳定作出贡献。The"Grand Mediation"system in Southwest Yi Region is a mechanism for resolving grassroots social conflicts and disputes,and it inherits and develops the"Fengqiao Experience".The counties and cities of Chuxiong Yi Autonomous Prefecture in Yunnan Province,located in the southwestern Yi region,have formed their own unique practices in actively exploring the"Grand Mediation"system and have achieved significant results.However,there are still shortcomings at the common and individual levels,such as insufficient national legal support,poor connection with the national judicial system,conflicts between customary law and national law,insufficient resource allocation,low social recognition,and the need to improve case handling efficiency.There are also insufficient numbers of"bilingual mediators"and"bilingual judges".Therefore,the"Grand Mediation"system in the Southwest Yi Region should be combined with the governance of litigation sources and grassroots social governance,and the construction of mediation organizations and teams should be strengthened in order to contribute to the harmony and stability of the society in the Southwest Yi Region.
