种业振兴视角下我国农民留种权制度研究

摘　　要：种业振兴是党和国家基于国内外形势作出的重大部署之一,加快推进种业振兴对于保障粮食安全、提高农民收入具有重要意义。农民留种权是种业振兴的重要组成部分,该制度对于以农业生产为主的农民在培育、筛选优良品种方面发挥着重要作用,我国法律规定中虽然规定农民具有植物新品种自繁自用的权利,但是有些细化规定仍然处于灰色地带。应当通过加强相关法律宣传提高农民对品种权保护的全面认识、在立法层面理清农民留种权权利主体范围、在执法层面上加大对自繁自用剩余种子出售审查与监管、在司法层面上合理分配农民因留种而产生的侵权责任等措施完善我国的农民留种权制度,全面促进种业振兴。The revitalization of the seed industry is one of the major arrangements made by the Party and the state based on domestic and foreign forms.Accelerating the revitalization of the seed industry is of great significance for ensuring food security and improving farmers'yield and income.The farmers'seed retention right is an important part of revitalizing the seed industry.Although the law of our country stipulates that farmers have the right to new plant varieties self-propagation and self-use.But some details remain in a gray area.We should strengthen the publicity of relevant laws to improve farmers'overall understanding of a variety of rights protection.At the legislative level,it is necessary to clarify the subject range of farmers'seed retention rights,strengthen the review and supervision of the sale of surplus seeds for self-propagation and self-use at the law enforcement level,and rationally distribute the tort liability caused by farmers'seed retention at the judicial level to improve the system of farmers'seed retention in our country and promote the comprehensive development of seed industry revitalization.
