摘　　要：目前,我国新就业形态劳动者权益维护面临着劳动关系认定困难、劳动基准无法执行、社会保险严重缺失的问题。在全面依法治国的背景下,应以法治思维探索新就业形态劳动者权益维护问题的解决路径。应加强适应劳动关系变化的法治建设,推动新就业形态领域劳动立法、加强新就业形态领域劳动执法监察和劳动法律监督、依法审慎处理新就业形态领域劳动争议、提升平台企业和新就业形态劳动者守法意识。在这一过程中,工会应提升自身组织化程度,聚焦维权和服务基本职责,以落实民主管理权和集体协商权为抓手,团结并引领新就业形态劳动者。At present,the protection of the rights and interests of workers in new forms of employment in China is faced with the problems of difficulties in establishing labor relations,unenforceable labor standards and a serious lack of social insurance.Against the background of ruling the country in accordance with the rule of law in a comprehensive manner,the path to solving the problem of safeguarding the rights and interests of workers in new forms of employment should be explored by thinking in accordance with the rule of law.The rule of law should be strengthened to address changes in labor relations in the digital economy,optimize labor legislation in the field of new forms of employment,strengthen labor law enforcement and supervision and labor law supervision in the field of new forms of employment,handle labor disputes in the field of new forms of employment in accordance with the law and in a prudent manner,and raise the awareness of law-abidingness among platform enterprises and workers in new forms of employment.In this process,trade unions should enhance their level of organization,focus on their basic duties of rights protection and service,and unite and lead workers in new forms of employment by implementing the rights to democratic management and collective consultation.
