摘 要:随着《“健康中国2030”规划纲要》的出台及“健康融入万策”的思想指引,国家逐步加强对劳动者职业安全卫生的法律保护。工作环境权由职业安全卫生权发展而来,以劳工参与为核心,涵盖劳动者职业病防治、劳动安全卫生保障、劳工参与决策、体面劳动保护等方面。目前,我国对工作环境权的学理与立法研究尚不成熟,工作环境权保障的法律制度尚未建立,劳动者遭遇生产安全事故、罹患职业病、过劳致死等问题时,缺乏请求权基础,无法获得有力的救济保障。因此,建议从权利本位的视角确立我国工作环境权,并完善配套的权利保障机制和法律应对路径,从而维系新时代和谐劳动关系。With the promulgation of the"Healthy China 2030"program and the idea of"Integrating Health into All Policies",the legal protection of workers'occupational safety and health has gradually strengthened.The right to working environment has evolved from the right to occupational safety and health,and is centered on labor participation,encompassing the prevention and treatment of occupational diseases,the protection of occupational safety and health,the participation of workers in decision-making,and the protection of decent work.At present,China's theoretical and legislative research on the right to a working environment is still immature,and a legal system for the protection of the right to a working environment has not yet been established,so when workers suffer production safety accidents,occupational diseases,or deaths due to overwork,they lack the basis for a right of petition and are unable to obtain strong relief protection.Therefore,it is recommended that the right to work environment in China be established from the perspective of the rights-based approach,and that the supporting rights protection mechanism and legal response path be improved,so as to maintain harmonious labor relations in the new era.
