摘　　要：新质生产力发展依靠创新发挥主导作用,知识产权是建设与新质生产力相适应生产关系的制度载体。现有理论对新质生产力的范畴内涵尚未达成充分共识,导致关于新质生产力发展路径研究缺乏针对性。生产力以产业为载体,从产业结构转型需求出发,发展新质生产力不限于追求未来技术、颠覆性技术创新,根本上是对科技作为第一生产力的需求强化,既包括通过创新壮大战略新兴产业、培育未来产业,也包括推动传统产业转型升级。作为创新驱动发展的主要制度载体,知识产权通过双重路径驱动新质生产力发展:一是支撑建设科技创新的市场导向机制,二是衔接市场力量和国家战略科技力量,保障科技创新的新型举国体制顺畅运行。面向新质生产力的发展要求,知识产权需从供给、需求、环境三个维度作出制度协同,从而优化知识产权创造供给,提升知识产权保护效能,加强知识产权转化运用,深度参与知识产权全球治理,建设有利于新质生产力发展的国内外制度环境。The development of new quality productive forces(NQPF)relies heavily on innovation,with intellectual property(IP)serving as the institutional vehicle for creating production relations compatible with these new forces.However,current theories lack a consensus on the conceptual connotation of NQPF,leading to research on development pathways that lack specificity.Productive forces are reflected through industrial structure systems.From the perspective of industrial structure transformation,developing NQPF involves not only the pursuit of future technologies and disruptive innovations but also a strengthened demand for technology innovation as the primary productive force.This includes both expanding strategic emerging industries and nurturing future industries through innovation,as well as promoting the transformation and upgrading of traditional industries.IP,as a primary institutional vehicle for innovation-driven development,can drive the development of NQPF through two pathways:first,by supporting the construction of market-oriented mechanisms for technological innovation,and second,by connecting market forces and national strategic technological forces,to ensure the smooth operation of the new system for mobilizing resources nationwide and technological innovation.To meet the development requirements of NQPF,IP needs to make institutional synergies from three dimensions of supply,demand and environment,so as to optimize the supply of IP,enhance the effectiveness of IP protection,strengthen the transformation and application of IP,participate in the global IP governance,and build up a domestic and international institutional environment that is conducive to the development of NQPF.
