海域立体分层使用权属界定及管理研究

摘　　要：海域立体确权管理是集约利用海域资源的必然趋势。海域立体分层设权不仅表现在纵向划分,而且可归属于不同的用海主体,更表现为对海域空间多元功能的综合性开发,以至于海域立体分层与权属界定面临着复杂性和管理上的难题,应对策略在于通过三维海籍管理技术实现对空间权属表达,海域立体分层使用权采用“部分”或“整体”出让方式,刻画以海域用途、用海指标、使用期限、出让时序等为要素的海域立体分层使用指引体系;空间弹性管理理念镶嵌于海域立体分层权属管理,通过分阶段划定、分步骤化解以及法律联动弹性机制实现对空间权属的精细化管理。这既是开展要素市场化配置综合改革的重要内容,也是自然资源资产产权制度改革的现实课题。Sea area three-dimensional confirmation management is the inevitable trend of intensive utilization of sea area resources.The three-dimensional stratification of sea area is not only reflected in the vertical division,but also belong to different sea users.It further manifests as the comprehensive development of multiple functions of sea area space,so that the three-dimensional stratification of sea area and the definition of ownership face complexity and management problems.The strategy for addressing this lies in achieving the expression of spatial ownership through three-dimensional seafaring management technology.The three-dimensional layered use right of sea area adopts the way of'part'or'whole'transfer,delineating a comprehensive system of guidelines for the three-dimensional layered use of sea area based on the use of sea area,sea use index,use period and transfer timing.The concept of spatial flexibility management is embedded in the three dimensional hierarchical ownership management of the sea area,and the fine management of spatial ownership is realized through the phased delineation,step-by-step resolution,and legal linkage flexibility mechanism.This is not only an important part of the comprehensive reform of market-oriented allocation of factors,but also a realistic subject of the reform of the property right system of natural resource assets.
