摘　　要：行政处罚裁量基准是有效规制行政处罚权的重要工具,体育行政处罚裁量权则是行政裁量权在体育法治领域内的具体映射。作为一项新生事物,需要以体育领域为切入视角,研究剖析体育行政处罚裁量基准制度的定位、构造和效力,以利于其在行政法治的框架内发挥效力并完成使命。总体而言,体育行政处罚裁量基准具有裁量性规则和说理性工具的双重定位,在内在构造上表现为要件联结效果的组合,而在外在构造上则是表现形式的不同呈现,并由此产生出主体、客体和内容层面上的法律效力。Administrative penalty discretionary benchmark is an important tool to effectively regulate the administrative penalty,sports administrative penalty discretion is the specific mapping of administrative discretion in the field of sports rule of law.As a new thing,need to take the field of sports as the entry point,study and analyze the positioning of sports administrative penalty discretionary benchmark system,structure and effectiveness,in order to facilitate its administrative rule of law framework to play a role in the effectiveness and fulfill the mission.Generally speaking,the sports administrative punishment discretionary benchmark has the dual position of discretionary rules and rational tools,the inner structure is manifested in the combination of the elements of the linkage effect,while the outer structure is the expression of different forms of presentation,and thus produce the subject,object and content of the three levels of legal effect.
