摘 要:环境刑事合规是检察机关主导下对涉环境犯罪企业的司法从宽处置措施。在现有的监管模式中,第三方监管人机制由于其独立性与专业性的优势,成为环境刑事合规监管机制的首要选择。但是,仍有必要在检察机关主导下建立并完善第三方监管人、环境行政机关、涉案企业内部机构共同参与的协同监管机制,理顺并调适检察机关与各监管参与主体之间的关系,使协同监管机制在检察机关主导下有条不紊地运作,从而保证环境刑事合规的犯罪治理实效。Environmental criminal compliance is a judicial leniency measure for enterprises involved in environmental crime leading by the procuratorate.The supervision mode of the thirdparty supervisor mechanism has become the primary choice of the environmental criminal compliance supervision mechanism due to its advantages of independence and professionalism.However,it is necessary to establish and improve the collaborative supervision mechanism jointly participated by the third-party supervisors,the environmental administrative organs and the internal institutions of the involved enterprises under the leadership of the procuratorial organs,straighten out and adjust the relationship between the procuratorial organs and the participants,so as to make the collaborative supervision mechanism operate in an orderly manner and ensure the effectiveness of such crime governance.
