摘　　要：实现担保物权程序在多个方面体现出不同于其他民事程序的特征。这些特征共同参与该程序之特质的塑造。这给准确认识和适用该程序提出挑战,是必须细致辨析并解决的问题。这种特质源起于立法者对该程序的功能设定,即以简便快捷的司法途径实现担保物权。程序中处理的实体法律关系及其纠纷所表现出的特征则为该程序特质的形成奠定了基础。在具体构造上,通过当事人设置、有限对抗、法官审查的方式和程度、针对不同情况赋予相应程序结果等一系列程序技术和安排,使该程序表现为一个组成部分之间彼此协调、共同推动程序功能实现的整体。未来应在密切观察司法实践状况的基础上进一步发现和提炼对该程序特质的认识,推动该程序的规则细化和有效适用,实现其与普通程序的良性竞争及错位发展。The procedure for the realization of a security rights reflects the characteristics that are different from other civil procedures in many aspects.Together,these characteristics contribute to the shaping of the program's idiosyncrasies.This poses a challenge to the accurate understanding and application of the procedure,and it is a problem that must be carefully identified and resolved.The characteristics of this procedure stem from the legislative function of implementing security rights through simple and efficient judicial ways.The characteristics of the substantive legal relationships and disputes lay the foundation for shaping the characteristics of the procedure.In terms of specific construction,through a series of procedural techniques and arrangements such as parties,adversarial structure in special form,judicial review methods,and different procedural results for various situations,the program is manifested as an internal component that coordinates with each other and contributes to the implementation of procedure functions.In the future,it is necessary to further discover and refine the understanding of the characteristics of the procedure on the basis of close observation of judicial practice,and promote the refinement and effective application of the rules of the procedure thus realize its healthy competition and dislocation development with ordinary procedures.
