论共同富裕的法治保障

摘　　要：共同富裕是中国式现代化的基本特色和本质要求。但共同富裕并不是一蹴而就的纯粹经济发展问题,而是需要在实践中兼顾“共同”与“富裕”的法治保障问题,其特征鲜明表现为既注重公平正义原则,又注重财富创造原则。结合当下中国特色社会主义发展的现状来看,这一双重原则表征了人们的现实合理性要求,既给予最广大人民以满足美好生活的需要,同时也为中华民族伟大复兴的实现铺平了实践进路。只有在正视这一现实合理性要求的前提下,促进共同富裕才会有工具理性基础上的价值理性张扬。而在现实的各种社会影响因素中,唯有法治才能承担起这一重要任务。在中国特色社会主义发展境遇下,共同富裕的法治保障需要以共聚宪法公正共识、共创法治保障体系和共享良法规约价值为核心内容而展开,其法治保障对于防止贫富差距扩大化、破除利益格局阶层化、社会生活极端市场化具有重要意义,其重要价值在于既维护共同富裕的正向性方向,同时又保证共同富裕的可持续性。Common prosperity is the basic feature and essential requirement of Chinese modernization.However,common prosperity is not a pure economic development issue that can be achieved overnight,but a legal development issue that needs to take into account both“common”and“prosperity”in practice,which is characterized by both the principle of equity and justice and the principle of wealth creation.Combined with the current situation of the development of socialism with Chinese characteristics,this dual principle represents people's realistic and reasonable requirements,which not only satisfies the needs of the vast majority of the people for a better life,but also paves the way for the realization of the great rejuvenation of the Chinese nation.Only on the premise of facing up to the requirement of realistic rationality,the promotion of common prosperity will have the publicity of value rationality on the basis of instrumental rationality.In the reality of various social factors,only the rule of law can undertake this important task.In the context of the development of socialism with Chinese characteristics,the rule of law statute for common prosperity needs to be carried out with the core content of gathering the consensus of constitutional justice,creating the rule of law guarantee system and sharing the value of the good law statute.The rule of law statute is of great significance in preventing the widening gap between the rich and the poor,breaking the stratification of the pattern of interests,and extreme marketization of social life.Its important value lies in not only maintaining the positive direction of common prosperity,but also ensuring the sustainability of common prosperity.
