摘 要:信息时代的计算思维给法学发展带来诸多挑战。计算思维包括对宏观社会规律的计算探究,也包括对个体思维的计算模拟。其核心技术路径分为符号主义与统计主义。计算思维可以从多个维度与法学产生结合,形成新的问题域。尽管这种结合便于把握某些宏观的“法学规律”,但计算操作中天然带有以均值和概率为内涵的价值筛选,这种筛选并不完全匹配法学自身侧重于个案解决的价值取向。所以,法学研究需要慎重对待计算之理由,即计算所代表的社会文化意涵。可以借助“视域融合”理论来妥当处理法学与计算交叉研究中“均值—异常值”的取舍困境。Computational thinking in the information age brings many challenges to the development of law.Computational thinking includes the computational exploration of macro-social laws,as well as the computational simulation of individual thinking.Its core technology path is divided into symbolism and statisticianism.Therefore,computational thinking can be fused with laws from many dimensions to form a new problem domain.Although this fusion is convenient to grasp some macroscopic“legal principles”,there is naturally a value screening with the connotation of mean and probability in the calculation operation,which does not completely match the value orientation of law itself focusing on case solving.Therefore,legal research needs to sensitively consider the rationales behind computation,including the social and cultural implications it encapsulates.The“horizon fusion”theory offers a potential solution to address the divergence between“means and outliers”at the convergence of jurisprudence and computing.
